eine Bekannte von mir hat 2 Wochen ein 400,00€-Job gamcht und gekündigt.

Jetzt hat sie eine Sanktion von 100 % des ALG II mit Mehrbedarf für Alleinerziehende für die Zeit vom 01. Juni - 31. August. Also auf angesmessene Kosten für Unterkunft und Heizung beschränkt.

aus den Gründen, dass die Kündigung keinen besonderen Grund hat und, dass sie das Alter von 25 Jahren noch nicht erreicht hat.

Das Essensgeld im Kindergarten wird zur Hälfte übernommen und Rest soll sie selber bezahlen von dem was sie noch zur Verfügung hat.

Zum Einkaufen soll sie sich Essensgutscheine beim Amt holen.
Werden diese später von ihrem Bedarf abgezogen?
Kann man da irgendetwas machen, dass nicht die 100% sondern weniger abgezogen werden? es handelt sich schließlich um einen Minijob..

Oben schreibst du, dass Sie eine Kürzung erhalten hat, aber die Kosten der Unterkunft weiter gezahtl werden und unten schreibst du, dass sie die Miete vom KG und UV zahlen soll. Bekommt sie denn jetzt noch was vom Amt oder nicht?

nun kommt drauf an warum sie den minijob gekündigt hat
jetzt spielt das thema zumutbarkeit eine rolle

ab den dritten lebensjahr kann sie vollzeit arbeiten gehn
sofern sicher gestellt ist das das kindbetreut wird

also du siehst es gibt eine menge wo man angreifen kann

um genau sagen zu können wo man anfängt müste man schon wissen

2 wichtige punkte sind das

1. die Sanktion ist zum ersten Mal
2. die Arbeit war zumutbar, an der Kasse. Gekündigt wurde aus persönlichen Gründen, sie hatte ständig hohe Differenzen, die sie aus eigener Tasche zahlen musste, das führte zu Depressionen, sie konnte nachts nicht schlafen, Durchfall, etc.
3. arbeiten kann sie Vollzeit, sucht auch Ausbildungsplatz und hat aufgrund dessen vom 04. Mai Praktika in 2 anderen Betrieben gemacht

Ich halte diese Sanktion für ungerechtfertigt...war sie mit ihren Beschwerden bei Arzt, hat sie ihm von den Gründen erzählt?

Geade weil nun diese Sanktion abgewendet werden muß - an ihrer Stelle würde ich meinem SB mitteilen, daß ich derartige Tätigkeiten für mich für unzumutbar halte und er deshalb den med. Denst einzuschalten hat...er, der SB , ist kein Arzt und kann das nicht entscheiden, inwieweit mich eine derartige Tätigkeit gesundheitlich belastet...
und das er mich in Zukunft mit Vermittlungsvorschlägen zu Kassentätigkeiten verschonen soll.

Eine Beschäftigung eigeninitiativ zu kündigen, kann ein so genannter wichtiger Grund für eine Sanktion sein.

Zum Einkaufen soll sie sich Essensgutscheine beim Amt holen.

Das soll sie unbedingt machen. Denn wenn sie Lebensmittelgutscheine erhält, übernimmt das Jobcenter auch wieder die Kosten für die Krankenversicherungsbeiträge. Ohne die Lebensmittelgutscheine bezahlt das Jobcenter keine Krankenversicherungsbeiträge.

Bei U25 schreibt das Gesetz in solchen Fällen vor: 1. Verstoß => Regelsatz wird um 100% gekürzt.

Achtung: bei wiederholtem Verstoß innerhalb eines Jahres wird nicht nur der Regelsatz um 100% gekürzt, sondern es werden auch die Miete und die Kosten für die Krankenkasse nicht bezahlt.

Aber:

(6) Eine Verkürzung des Sanktionszeitraumes von 3 Monaten auf 6 Wochen ist auch möglich, wenn über den Eintritt der Sanktion bereits ein Bescheid erlassen wurde und der Hilfebedürftige nachträglich Gründe vorträgt, die eine geringere Sanktion rechtfertigen.

könnt ihr uns irgendwelche Tipps geben?

Sie hätte vor der Kündigung zu einem Arzt gehen sollen, der ihr bescheinigt hätte, dass sie den Job nicht ausüben kann. Jetzt ist das wahrscheinlich zu spät. Oder kann sie jetzt zu einem Arzt gehen, der ihr im Nachhinein diese Bescheinigung ausstellt? Dann hätte auch ein Widerspruch gegen den Sanktionsbescheid wahrscheinlich/vielleicht Erfolg.

sie hat sich nach den 14 Tagen an der Kasse 2 Wochen krankschreiben lassen, ihr war schlecht, Kopfschmerzen, Durchfall, etc.

Hier muss der § 10 SGB II Zumutbarkeit angewendet werden , da ja darauf hingewiesen wurde das sie die Arbeit an der Kasse nicht schaffen kann.

Sanktion ist nicht zulässig und rechtswidrig.

Es darf nicht höher Sanktioniert werden bei U 25 jährigen weil,

wenn die nicht in der lage ist diese arbeiten zu machen

artzt hat sie eingeschaltet
er muss nun bestättigen das sie die arbeiten an der kasse psychish nicht in der lage ist diese arbeiten zu machen

dann wurde sie eingestellt zum waren ein zuräumen und was da noch mit zu tun hat

kasse auf probe
konnte sie nicht
und der cheff wollte sie nicht ihre vertraglichen arbeiten machen lassen sondern weiterhin an der kasse

was steht drin im arbeitsvertag ?
steht da was auch drin von kasse ?
wenn nicht kommt hier schon vertragsbruch mit imspiel

das alles sind schonmal gründe
die keine sanktion rechtfertigen würden

also zum artzt sich das bestättigen lassen
zum vertrag muss sie mal rein schauen ob diese arbeiten mit dazugehören oder nicht
grad diese franchies unternehmen arbeiten zu99% unsauber

wichtig die bescheinigung das sie nicht fähig ist diese arbeit zu leisten was die kassse angeht
damit hat sie schon gewonnen bei gericht

sie hat sich nach den 14 Tagen an der Kasse 2 Wochen krankschreiben lassen, ihr war schlecht, Kopfschmerzen, Durchfall, etc.

Beim Arzt war sie - aber sie hat Ihm nicht gesagt das es wegen der Arbeit ist direkt... aber sie geht montag nochmal zum Arzt und versucht ihm das nochmal ausführlich zu schildern um zu schauen ob sie nachträglich noch ne bescheinigung von ihm bekommt!

Und noch eine Frage: Wie ist das eigentlich nun wenn sie jetzt nen neuen 400€ Job findet ??? Wie wird das denn alles berechnet wegen der laufenden Sanktion?

260,66 Euro beträgt die Differenz zur tatsächlichen Miete.
371,17 Miete - 110,51 ausgezahlt = 260,66 Differenz

Damit der Differenzbetrag von 260,66 für den Vermieter zusammenkommt,
muss das Kind einmal seine eigene Miethälfte bezahlen (185, 59€) und
zusätzlich aus dem Kindergeld weitere 75,07 für die Mietkosten der Mutter abgeben.

Als Quelle kommt nur das Kindergeld in Frage.
(denn der Unterhaltvorschuss ist tabu für die Mutter)

Die Bundesregierung legt in ihrer Antwort (BT-Drs. 17/198) auf eine Kleine Anfrage der Linksfraktion (BT-Drs. 17/66) dar, wie sich der Leistungsanspruch eines Hilfeberechtigten berechnet, dessen Arbeitslosengeld II aufgrund einer Sanktion gekürzt wurde und der zugleich eine geringfügige Beschäftigung aufnimmt.

Darin heißt es:

Ermittlung des ungedeckten Bedarfes

In einem weiteren Schritt sei der ungedeckte Bedarf der von der Sanktion betroffenen Hilfebedürftigen zu ermitteln. Nähmen Hilfebedürftige eine Beschäftigung auf, sei der Leistungsanspruch ab dem Monat, in dem Einkommen erstmalig zufließt, neu zu berechnen, erläutert die Bundesregierung. Dabei seien die aus einer nicht bedarfsdeckenden Beschäftigung herrührenden Einnahmen bedarfsmindernd als Einkommen zunächst auf die Geldleistungen der Agentur für Arbeit und erst dann auf die der kommunalen Träger anzurechnen.

Konkrete Berechnung des Leistungsanspruchs

Der so festgestellte grundsätzlich bestehende Leistungsanspruch würde schließlich in einem dritten Schritt um den zuvor festgestellten Absenkungsbetrag vermindert, heißt es in der Antwort. Auch hier erfolge der Abzug in der Reihenfolge, dass zunächst eine Kürzung der Geldleistungen der Agentur für Arbeit und erst dann eine solche der kommunalen Träger erfolge. Sei der nach Berücksichtigung des Einkommens verbleibende Leistungsanspruch geringer als der Minderungsbetrag, entfalte die Sanktion keine oder nur eingeschränkte Wirkung, so die Bundesregierung.
